By creating an account, subscribing, or otherwise using the StockSetups website, dashboard, email digests, and related services (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and current.
2. Accounts
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at support@stocksetups.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. The Service
StockSetups scans the full US-equities universe (~12,300 US stocks and ETFs) after the U.S. market close, detects chart and candlestick patterns on the daily timeframe, classifies each long setup into status lanes, scores it, and publishes the results to the dashboard and (for subscribers) an email digest. An always-on engine also generates real-time intraday alerts during market hours, which subscribers may receive on the dashboard and in an email digest (Discord, Telegram, or webhook delivery is planned). We do not guarantee that the Service will be uninterrupted, error-free, timely, or that any signal, alert, pattern classification, price level, or fundamental data point is accurate or complete.
Market and company data is sourced from third parties (including Databento and SEC EDGAR). Such data may be delayed, incomplete, or contain errors, and is provided “as is.” We may add, modify, suspend, or discontinue any part of the Service at any time.
4. Subscriptions, billing & trials
- The Service is offered on a free tier (limited preview) and a paid “Pro” tier billed monthly or annually.
- New subscribers begin Pro with a 14-day free trial. A payment method is required to start the trial; you are not charged during it, and the first charge is taken when the trial ends unless you cancel beforehand. The trial is offered once per customer.
- Paid subscriptions are processed by our payment provider, Stripe. By subscribing you authorize recurring charges to your payment method when the trial ends (or immediately if no trial applies) and at each renewal until you cancel.
- Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled beforehand. We may change prices on a prospective basis with notice; changes take effect at your next renewal.
- You can cancel at any time from your account or the Stripe billing portal. Cancellation stops future renewals; you keep Pro access through the end of the current paid period.
Refunds and cancellations are governed by our Refunds & Cancellations policy.
5. Acceptable use
You agree not to:
- Resell, redistribute, scrape, republish, or commercially exploit the Service or its data without our written permission;
- Share your account, circumvent access controls, or attempt to access tiers or data you have not paid for;
- Interfere with, overload, reverse engineer, or attempt to disrupt the Service or its infrastructure;
- Use the Service in violation of any applicable law, regulation, or third-party right.
6. Intellectual property
The Service, including its software, pattern-detection logic, design, text, and branding (“StockSetups”), is owned by SCRIPTTHEMARKET LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms. The underlying market data remains the property of its respective providers.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE OR ANY SIGNAL WILL BE PROFITABLE OR MEET YOUR EXPECTATIONS. PAST PATTERN PERFORMANCE DOES NOT GUARANTEE FUTURE RESULTS.
8. Limitation of liability
To the maximum extent permitted by law, SCRIPTTHEMARKET LLC and its officers, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading or investment losses, loss of profits, or loss of data, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless SCRIPTTHEMARKET LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
11. Governing law
These Terms are governed by the laws of the United States and the state in which SCRIPTTHEMARKET LLC is organized, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims resolution.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, by notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
